You are also not liable for defects that arise after your vehicle has been handed over. An exclusion of liability for material defects is common when selling to a dealer and means that a seller is generally not liable for defects in the vehicle. Existing defects that are known to the buyer before the purchase or before bidding are of course not covered by the liability for material defects or any other liability.
The situation is different if you deliberately make false statements during the sale, for example about the mileage, equipment, condition or similar important characteristics ("fraudulent misrepresentation"). Malicious misrepresentation occurs, for example, if a seller is aware of a notable or serious defect and deliberately conceals this from the buyer. It makes no difference whether you are selling to a dealer or a private individual.
