Existing defects that are known to the buyer before the purchase or before bidding are of course not covered by the liability for material defects or any other liability.

The situation is different if you deliberately make false statements during the sale, for example about the mileage, equipment, condition or similar important characteristics ("fraudulent misrepresentation"). Malicious misrepresentation occurs, for example, if a seller is aware of a notable or serious defect and deliberately conceals this from the buyer. It makes no difference whether you are selling to a dealer or a private individual.
